These Terms constitute a legally binding agreement between you and Etelson Alcius, the operator of Scout. We may update these Terms from time to time. Continued use of Scout after changes are posted constitutes your acceptance of the updated Terms.
Scout is an AI-powered roommate matching platform that helps users find compatible roommates and rental listings in San Francisco and New York City. Scout provides:
Scout is not a real estate broker, rental agent, or property manager. We do not list, own, manage, or guarantee any property or rental listing. We facilitate introductions and surface listings — all transactions, agreements, and decisions are made directly between users and landlords or other users.
You must meet the following requirements to use Scout:
By using Scout, you represent and warrant that you meet all eligibility requirements.
Accurate information: You agree to provide accurate, current, and complete information when creating your profile and using Scout. Providing false information — including fake budget ranges, false move-in dates, fabricated lifestyle preferences, or misrepresentation of your identity — is a violation of these Terms and may result in account termination.
Account security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@scout.app if you believe your account has been compromised.
One account per person: You may only maintain one Scout account. Creating multiple accounts to circumvent a ban or manipulate the matching system is prohibited.
By providing your phone number to Scout, you consent to receive SMS messages from us including match alerts, listing notifications, verification codes, and product updates.
To opt out: Text STOP to any Scout message at any time. We do not sell or share your phone number with third parties for their marketing purposes. See our Privacy Policy for full details on how we handle your information.
You agree to use Scout only for lawful purposes and in a manner consistent with these Terms. You agree not to:

Scout is committed to compliance with the Fair Housing Act and all applicable state and local fair housing laws. You agree to use Scout in a manner consistent with fair housing obligations.
As a user seeking or offering housing, you may not discriminate based on race, color, national origin, religion, sex, familial status, disability, or any other characteristic protected under applicable law.
Scout's matching system is designed to connect users based on lifestyle compatibility, budget, timing, and location — not protected characteristics. If you believe Scout's platform or another user has engaged in discriminatory conduct, please report it to privacy@scout.app immediately.
Scout aggregates listings from third-party platforms including Craigslist, Reddit, Facebook groups, and Discord. With respect to third-party listings:
Third-party listings are not verified. Scout does not verify the accuracy, completeness, or legitimacy of listings sourced from Craigslist, Reddit, Facebook, Discord, or any other third-party platform. Scout is not liable for any loss, damage, or harm arising from your reliance on third-party listing content. Always conduct your own due diligence before paying a deposit or transferring money.
When you create a profile, submit preferences, or otherwise contribute information to Scout, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and process that information to provide and improve the Service.
You represent that any information you provide does not violate the rights of any third party and is not false, misleading, or defamatory.
We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to the platform or its users.
Your use of Scout is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Scout, you consent to the collection and use of your information as described in the Privacy Policy.
All content, features, and functionality of Scout — including but not limited to the Scout brand, Nova agent, matching algorithms, design, code, and text — are owned by Etelson Alcius and protected by applicable intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any Scout content without our express written permission.
No guarantee of matches: Scout does not guarantee that you will find a roommate, secure housing, or that any match will result in a successful living arrangement.
No guarantee of listing accuracy: Scout does not guarantee the accuracy, availability, or legitimacy of any listing surfaced through the platform.
No guarantee of compatibility: Scout's AI-powered compatibility matching is designed to improve the likelihood of compatible roommate relationships. We do not guarantee that any match will result in a harmonious living situation.
Service availability: We do not guarantee that Scout will be available at all times or free from errors, interruptions, or technical issues.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCOUT AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF SCOUT SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Scout and its operator from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of Scout, your violation of these Terms, or your violation of any third-party rights.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason including violation of these Terms, fraudulent activity, or conduct harmful to other users or the platform.
Upon termination, your right to use Scout ceases immediately. We may retain certain information as required by law or for legitimate business purposes as described in our Privacy Policy.
You may terminate your account at any time by contacting us at privacy@scout.app.
Informal resolution: Before filing any formal legal claim, you agree to contact us at privacy@scout.app and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving your notice.
Governing law: These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions.
Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.
Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scout regarding your use of the Service.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.
